Acceptance of Terms

By accessing and using the website alphaluxisum.world and the services provided by alphaluxisum d.o.o. (Registration Number: 526391742), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and alphaluxisum d.o.o., a company registered in Croatia with its principal place of business at Masarykova ulica 102, Split 21663, Croatia.

User Obligations

Payment Terms

  • Invoices are payable within 30 days of issue
  • Late payments may incur interest charges as permitted by law
  • All prices are exclusive of applicable taxes unless stated otherwise
  • Payment disputes must be raised within 15 days of invoice receipt

Intellectual Property

All intellectual property rights in our website, services, software, documentation, and proprietary methodologies remain the exclusive property of alphaluxisum or our licensors. This includes but is not limited to:

  • Software code, algorithms, and technical implementations
  • Dashboard designs, templates, and user interfaces
  • Documentation, training materials, and methodologies

Custom solutions developed specifically for clients may include shared intellectual property rights as defined in individual service agreements. Client data and business information remain the property of the client, subject to our privacy policy and data processing agreements.

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Croatian data protection laws. Our collection, use, and protection of personal information is governed by our Privacy Policy, which forms an integral part of these terms.

For analytics services, we will process client data only as necessary to provide the agreed services and in accordance with applicable data protection regulations and contractual obligations.

Confidentiality

We understand that clients may share confidential business information during the course of our engagement. We commit to:

  • Maintaining strict confidentiality of all client information
  • Using client information only for the purpose of providing agreed services
  • Implementing appropriate security measures to protect confidential data
  • Not disclosing client information to third parties without explicit consent
  • Returning or destroying confidential information upon request or contract termination

Limitation of Liability

To the maximum extent permitted by law, alphaluxisum's liability for any claims arising from our services is limited to the total amount paid by the client for the specific services giving rise to the claim during the twelve months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

Service Availability

While we strive to provide reliable services, we do not guarantee uninterrupted availability of our website or services. We reserve the right to suspend or modify services for maintenance, updates, or other operational requirements with reasonable notice where possible.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Split, Croatia.

If you are a consumer resident in another EU member state, you may also have rights under the consumer protection laws of your country of residence.

Termination

Either party may terminate service agreements in accordance with the specific termination clauses outlined in individual contracts. We reserve the right to suspend or terminate access to our website and services immediately if:

  • You breach these terms or any applicable service agreement
  • Your use of our services poses a security risk or legal liability
  • You fail to make required payments after appropriate notice
  • We are required to do so by law or regulatory authority
